A Phase I identifies recognized environmental conditions from the presence or likely presence of any hazardous substances or petroleum products in, on, or at a property: (1) due to any release to the environment; (2) under conditions indicative of a release to the environment; or (3) under conditions that pose a material threat of a future release to the environment.
A Phase I assesses the presence or likely presence of recognized environmental conditions in soil, soil gas, or groundwater from current/historical site use, adjoining site use (e.g. dry cleaners), or ongoing investigations in the vicinity.
A Phase I satisfies one of the requirements to qualify for CERCLA’s landowner liability protections by completing “all appropriate inquiries into the previous ownership and uses of the property consistent with generally accepted good commercial and customary standards and practices.”
